Privacy Policy – Information on processing of personal data<\/span><\/strong><\/h1>\n

This document describes how we process personal data. <\/span><\/span>The privacy
\nnotice is a translation of the German document
\n(“Datenschutzerkl\u00e4rung”). Should there be discrepancies between the
\nGerman and English, the German version shall prevail.<\/span><\/span><\/p>\n<\/div>\n<\/div>\n

We, the company LogSystems F\u00f6rdertechnik und
\nAutomatisierungs- GmbH & Co. KG<\/span><\/span> (hereinafter named “the
\ncompany”, “we” or “us”), thank you for visiting our
\nwebsite and for your interest in our company and our services. Your personal
\ndata will only be processed in accordance with the provisions of German and
\nEuropean data protection law.<\/span><\/span><\/p>\n<\/div>\n

Data protection law obliges us, as the entity
\nresponsible for data processing, to ensure the protection of your personal data
\nthrough a variety of measures. One of these obligations is to inform you
\ntransparently about the type, scope, purpose, duration<\/span>
\nand legal basis of the data processing (cf. Art.\u00a013 and 14 EU-GDPR). In
\nthe following, we also address you as the person affected by the data
\nprocessing with “customer”, “user”, “you” or
\n“data subject”. In this privacy policy, we inform you about how your
\npersonal data is processed by us.<\/span><\/p>\n<\/div>\n

Our privacy policy has a modular structure. It consists of a general
\npart for any processing of personal data and processing situations that come
\ninto play and a special part, the content of which relates in each case only to
\nthe processing situation specified there. It is possible that we will use this
\nonline document to also inform you about processing operations that do not
\nprimarily take place on the website. You will find these in the special section

Following the example of Art.\u00a04 EU-GDPR, this document is based on
\nthe following definitions:<\/span><\/span><\/p>\n<\/div>\n

“Personal data” (Art.\u00a04 No.\u00a01 EU-GDPR)
\nmeans any information relating to an identified or identifiable natural person
\n(“data subject”). A person is identifiable if he or she can be
\nidentified, directly or indirectly, in particular by<\/span>
\nreference to an identifier such as a name, an identification number, an online
\nidentifier, location data or by means of information relating to his or her
\nphysical, physiological, genetic, mental, economic, cultural or social identity
\ncharacteristics. The identifiability can also be given by means of a linkage of
\nsuch information or other additional knowledge. The origin, form or embodiment
\nof the information is irrelevant (photographs, video or audio recordings may
\nalso contain personal data).<\/span><\/p>\n<\/div>\n

“Processing” (Art.\u00a04 No.\u00a02 EU-GDPR)
\nmeans any operation which involves the handling of personal data, whether or not<\/span> by means of automated (i.e. technology-based)
\nprocesses. This includes, in particular, collection<\/span>
\n(i.e. acquisition), recording, organization, arrangement, storage, adaption or
\nmodification, readout, query, use, disclosure by transmission, dissemination or
\notherwise making available, alignment, combination, restriction, deletion or
\ndestruction of personal data, as well as the change of a purpose or intended
\nuse on which a data processing was originally based.<\/span><\/p>\n<\/div>\n

\n

“Controller” (Art.\u00a04 No.\u00a07 EU-GDPR)
\nmeans the natural or legal person, public authority, agency<\/span>
\nor other body which alone or jointly with others determines the purposes and
\nmeans of the processing of personal data.<\/span><\/p>\n<\/div>\n

\n

“Third party” (Art.\u00a04 No.\u00a010 EU-GDPR)
\nmeans any natural or legal person, public authority, agency or other body other
\nthan the data subject, the controller, the processor and the persons who are
\nauthorized to process the personal data under the direct responsibility of the
\ncontroller or processor.”<\/span><\/p>\n<\/div>\n

\u201cProcessor” (Art.\u00a04 No.\u00a08 EU-GDPR) is a
\nnatural or legal person, authority, institution<\/span> or
\nother body that processes personal data on behalf of the controller, in
\nparticular in accordance with the controller’s instructions (e.g. IT service
\nprovider). In particular, a<\/span> processor is not a third
\nparty in the sense of data protection law.<\/span><\/p>\n<\/div>\n

“Consent” (Art.\u00a04 No.\u00a011 EU-GDPR) of the data
\nsubject means any freely given, specific, informed<\/span> and
\nunambiguous indication of his or her wishes in the form of a statement or other
\nunambiguous affirmative act by which the data subject signifies his or her
\nagreement to the processing of personal data relating to him or her.<\/span><\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n

As the data subject, you have the right:<\/span><\/p>\n<\/div>\n

– in accordance with Art.\u00a015 EU-GDPR to request information about your data
\nprocessed by us<\/span><\/strong>. In particular, you can request information
\nabout the processing purposes, the category of data, the categories of
\nrecipients to whom your data has been or will be disclosed, the planned storage
\nperiod, the existence of a right to rectification, deletion, restriction of
\nprocessing or objection, the existence of a right of complaint, the origin of
\nyour data if it was not collected by us, as well as the existence of automated
\ndecision-making, including profiling, and, if applicable, meaningful
\ninformation about its details;<\/span><\/p>\n<\/div>\n

– in accordance with Art. 16 EU-GDPR to demand the
\ncorrection of incorrect or the completion of your data stored by us without delay;<\/span><\/span><\/p>\n<\/div>\n

\nstored by us<\/span><\/strong>, unless the processing is necessary for the
\nexercise of the right to freedom of expression and information, for compliance

\nin accordance with Art.\u00a018 EU-GDPR, to
\nrequest the restriction of the processing of your data<\/span><\/strong>, insofar
\nas the accuracy of the data is disputed by you or the processing is unlawful;<\/span><\/p>\n<\/div>\n

– in accordance with Art.\u00a020 EU-GDPR to receive
\nyour data that you have provided to us in a structured, common and
\nmachine-readable format or to request the transfer to another controller
\n(“data portability”);<\/span><\/span><\/p>\n<\/div>\n

– in accordance with Art.\u00a021 EU-GDPR to object to the processing<\/span><\/strong>
\nprovided that the processing is based on Art.\u00a06 para.\u00a01 lit.\u00a0e
\nor lit.\u00a0f EU-GDPR. This is particularly the case if the processing is not
\nnecessary for fulfilling a contract with you. Unless it is an objection to
\ndirect marketing, when exercising such an objection, we ask you to explain the
\nreasons why we should not process your data as we have done. In the event of
\nyour justified objection, we will review the situation and either discontinue
\nor adjust the data processing or show you our compelling legitimate grounds on the basis of<\/span> which we will continue the processing. For
\nmany services on our websites that process personal data on
\nthe basis of<\/span> Art.\u00a06 para.\u00a01 lit.\u00a0f EU-DSGVO, the
\nobjection can be implemented technically via technologies available or to be
\ninstalled in the browser, e.g. by blocking JavaScripts or cookies;<\/span><\/span><\/p>\n<\/div>\n

– in accordance with Art.\u00a07 para.\u00a03 EU-GDPR,
\nto revoke your consent
\ngiven once<\/span><\/strong> (also prior to the application of the EU-GDPR, i.e.
\nprior to 25.5.2018) – i.e. your voluntary will, made understandable in an
\ninformed manner and unambiguously by a declaration or other unambiguous
\nconfirming act, that you agree to the processing of the personal data in
\nquestion for one or more specific purposes – at any time vis-\u00e0-vis us, if you
\nhave given such consent. This has the consequence that we may no longer
\ncontinue the data processing, which was based on this consent, for the future
\nand<\/span><\/p>\n<\/div>\n

– in accordance with Art.\u00a077 EU-GDPR to complain to a data
\nprotection supervisory authority about the processing of your personal data in
\nour company, such as the data protection supervisory authority responsible for

Legal basis of data processing<\/span><\/i><\/strong><\/i><\/h2>\n<\/div>\n

By law, in principle, any processing of personal data is allowed only if
\nthe data processing falls under one of the following justifications:<\/span><\/span><\/p>\n

\nEU-GDPR (“consent”): If the data subject has voluntarily, in an
\ninformed manner and unambiguously indicated by means of a statement or other
\nunambiguous affirmative act that he or she consents to the processing of
\npersonal data concerning him or her for one or more specific purposes;<\/span><\/p>\n<\/div>\n

Art.\u00a06 para.\u00a01 lit.\u00a0b EU-GDPR
\n(“Contract”): if the processing is necessary for the fulfillment of a
\ncontract to which the data subject is party or for the performance of
\npre-contractual measures taken at the data subject’s request;<\/span><\/span><\/p>\n<\/div>\n

Art.\u00a06 para.\u00a01 lit.\u00a0c EU-GDPR
\n(“legal obligation”): If processing is necessary for compliance with
\na legal obligation to which the controller is subject (e.g. a legal obligation
\nto keep records);<\/span><\/span><\/p>\n<\/div>\n

\n

Art.\u00a06 para.\u00a01 lit.\u00a0d EU-GDPR: When
\nprocessing is necessary to protect the vital interests of the data subject or
\nanother natural person;<\/span><\/span><\/p>\n<\/div>\n

\n

Art.\u00a06 para.\u00a01 lit.\u00a0e EU-GDPR: Where
\nprocessing is necessary for the performance of a task carried out in the public
\ninterest or in the exercise of official authority vested in the controller or<\/span><\/p>\n<\/div>\n

\n

Art.\u00a06 para.\u00a01 lit.\u00a0f EU-GDPR
\n(“Legitimate Interests”): If the processing is necessary to protect
\nthe legitimate (in particular legal<\/span> or economic)
\ninterests of the controller or a third party, unless the conflicting interests
\nor rights of the data subject override (in particular if the data subject is a
\nminor). Insofar as the processing of personal data is based on Art.\u00a06
\npara.\u00a01 lit.\u00a0f EU-GDPR, the aforementioned purposes<\/span>
\nalso constitute our legitimate interests.<\/span><\/p>\n<\/div>\n

In the following, we indicate the applicable legal basis for each of the
\nprocessing operations we carry out. A processing operation may also be based on
\nseveral legal bases.<\/span><\/span><\/p>\n<\/div>\n<\/div>\n

Data deletion and storage duration<\/span><\/i><\/strong><\/i><\/h2>\n<\/div>\n
\n

For the processing operations carried out by us, we indicate below in
\neach case how long the data will be stored by us and when it will be deleted or
\nblocked. In the case of consent, the data deletion and storage duration
\nspecified in the consent request is decisive. If no explicit storage duration
\nis specified below, your personal data will be deleted or blocked as soon as
\nthe purpose or legal basis for the storage no longer applies. As a matter of
\nprinciple, your data will only be stored in the territory of the Federal
\nRepublic of Germany, in a member state of the European Union (EU) or in another
\ncontracting state of the Agreement on the European Economic Area (EEA).
\nPossible exceptions to this are outlined in the following sections and
\nprocessing procedures. However, storage may take place beyond the specified
\ntime in the event of a (threatened) legal dispute with you or other legal
\nproceedings or if storage is provided for by statutory provisions to which we
\nare subject as the responsible party (e.g. \u00a7\u00a0257 HGB, \u00a7\u00a0147 AO). If
\nthe storage duration prescribed by the legal regulations expires, the personal
\ndata will be blocked or deleted unless further storage by us is necessary and
\nthere is a legal basis for this.<\/span><\/span><\/p>\n<\/div>\n<\/div>\n

Data security: website, e-Mail, Fax<\/span><\/i><\/strong><\/i><\/h2>\n<\/div>\n
\n

We use technical and organizational security measures to protect your
\ndata against accidental or intentional manipulation, partial or complete loss,
\ndestruction or against unauthorized access by third parties (e.g. TLS
\nencryption for our website), taking into account<\/span> the
\nstate of the art, implementation costs and the scope, context and purpose of
\nthe processing, as well as the existing risks (including their probability and
\nimpact) for the data subject. Our security measures are continuously improved
\nin line with technological developments.<\/span><\/span><\/p>\n

\n

For secure data transmission on the Internet, we use
\nthe hybrid encryption protocol Transport Layer Security (TLS), more widely
\nknown by its predecessor name Secure Sockets Layer Software (SSL). This
\nsoftware encrypts the information that is transmitted by you. All information
\nrelevant to data protection is stored in encrypted form in a protected
\ndatabase.<\/span><\/p>\n<\/div>\n

\n

We would like to point out that the confidentiality of
\ne-mail cannot be proven. Although we offer transport encryption (TLS) via our
\nmail servers, confidentiality may depend on various mail relay servers over
\nwhich we have no control: Whether these also use TLS and whether they evaluate
\nthe emails is beyond our control.<\/span><\/p>\n<\/div>\n

\n

When you send us a fax, the transmission takes place
\nvia the Internet Protocol (FoIP). The transmission is technically identical to
\nsending an e-mail or web page data. We do not know if an IP-based service
\nencrypts data accordingly the confidentiality of the sent data is not
\nguaranteed. We do not recommend sending sensitive data by fax.<\/span><\/p>\n<\/div>\n

Cooperation with contract processors<\/span><\/i><\/strong><\/i><\/h2>\n<\/div>\n
\n

As with any larger company, we also use external service providers to
\nhandle our business transactions, e.g. for the areas of IT, logistics,
\ntelecommunications, parcel delivery, sending letters or e-mails, analyzing our
\ndatabases, advertising measures, processing payments, sales<\/span>
\nand marketing. These service providers have access to personal data needed to
\nperform their tasks. However, they may not use this data for any other purpose.
\nProcessors only act on our instructions and have been contractually obligated
\nwithin the meaning of Art.\u00a028 EU-DSGVO to comply with the provisions of
\ndata protection law. Processors are not third parties.<\/span><\/span><\/p>\n<\/div>\n<\/div>\n

Precondition for the transfer of
\npersonal data to third countries<\/span><\/span><\/i><\/strong><\/i><\/h2>\n<\/div>\n
\n

In the framework of our business relationships, your personal data may
\nbe transferred or disclosed to third party companies. These may also be located
\noutside the European Economic Area (EEA), i.e. in third countries. Such
\nprocessing is carried out exclusively for the fulfillment of contractual and
\nbusiness obligations and to maintain your business relationship with us. We
\nwill inform you about the respective details of the transfer in the following
\nat the relevant points.<\/span><\/span><\/p>\n

The European Commission certifies that some third countries have a level
\nof data protection comparable to the EEA standard by means of so-called
\nadequacy decisions. However, in other third countries to which personal data
\nmay be transferred, there may not be a consistently high level of data
\nprotection due to a lack of legal provisions. If this is the case, we ensure
\nthat data protection is adequately guaranteed. This is possible through binding
\ncompany regulations, standard contractual clauses of the European Commission
\nfor the protection of personal data, certificates<\/span> or
\nrecognized codes of conduct. Please contact our data protection team if you

We do not make the conclusion of contracts with us dependent on you
\nproviding us with personal data in advance. As a customer, you are under no
\nlegal or contractual obligation to provide us with your personal data; however,
\nwe may only be able to provide certain services to a limited extent or not at
\nall if you do not provide the necessary data. If this should exceptionally be
\nthe case within the scope of the products or processing procedures presented

\n“websites”). When you visit our websites, personal data will be

\nnecessary to achieve the above-mentioned processing purposes; the legal bases

Persons employed to carry out our business operations
\n(e.g. auditors, banks, insurance companies, legal advisors, supervisory
\nauthorities, parties involved in company acquisitions or the establishment of
\njoint ventures). The legal basis for the disclosure is then Art.\u00a06 para.\u00a01
\nlit. b or lit.\u00a0f EU-GDPR.<\/span><\/p>\n<\/div>\n

In addition, we will only disclose your personal data to third parties
\nif you have given your express consent to do so in accordance with Art.\u00a06 para.\u00a01

The processing of the log data serves statistical
\npurposes and the improvement of the quality of our website, in particular the
\nstability and security of the connection (legal basis is Art.\u00a06 para.\u00a01
\nlit.\u00a0f EU-GDPR). <\/span><\/p>\n<\/div>\n

It is possible that further information that your operating system, your
\nbrowser and\/or other of your technologies provide to our web servers, we
\nprocess at short notice to provide the websites. The legal basis for this is
\nalso Art.\u00a06 para.\u00a01 lit.\u00a0f EU-GDPR.<\/span><\/span><\/p>\n<\/div>\n<\/div>\n

Services to store information on
\nyour terminal or to access information already stored on your terminal
\n(cookies, plugins, JavaScript …)<\/span><\/i><\/strong><\/i><\/h2>\n<\/div>\n

On our websites, we use services and technologies to store information
\non your terminal device and\/or technologies to access information that is
\nalready stored on your terminal device. These technologies can be cookies, for
\nexample. Cookies are text files and\/or entries in the browser’s own database,
\nwhich assigns the browser you are using by a characteristic string. In the
\nprocess, certain information flows between the entity that sets the cookie and

Cookies and other services may contain data that make
